Virginia filing deadlines for asbestos and mesothelioma lawsuits

Virginia has a specific accrual rule for asbestos-related personal-injury actions. Under Virginia Code § 8.01-249(4), an asbestos claim generally accrues when a physician first communicates a diagnosis of asbestosis, interstitial fibrosis, mesothelioma, or another disabling asbestos-related injury or disease to the person or the person's agent.

General Virginia deadlines

Personal injury: Virginia Code § 8.01-243 generally provides a two-year period for personal-injury actions after the cause of action accrues.

Asbestos-specific accrual: Virginia Code § 8.01-249(4) generally ties accrual to the date a physician first communicates the asbestos-related diagnosis. The statute also provides that a later malignant asbestos diagnosis is treated as a separate injury from an earlier nonmalignant asbestos diagnosis.

Death limitation within the asbestos provision: The asbestos accrual provision states that no such action may be brought more than two years after the person's death.

Wrongful death: Virginia Code § 8.01-244 generally requires a wrongful-death action to be filed by the personal representative within two years after death.

Other proceedings: Workers' compensation, maritime claims, federal employment, veterans' benefits, asbestos bankruptcy trusts, governmental defendants, and exposure in other states may involve different rules and deadlines.
