Louisiana calls many civil filing deadlines prescriptive periods. The correct period may depend on when the injury or damage was legally sustained, when the cause of action arose, the date of death, whether a survival or wrongful-death claim is involved, the defendants, maritime or federal law, workers' compensation, asbestos bankruptcy trusts, and whether another jurisdiction's law applies.

General Louisiana deadlines

Delictual or tort actions: Louisiana Civil Code Article 3493.1 generally provides a two-year prescriptive period beginning on the day injury or damage is sustained. Article 3493.1 became effective July 1, 2024.

Prospective application: Act 423 of 2024 states that the change applies prospectively. Claims arising before July 1, 2024 may remain governed by the former one-year rule or other applicable law, so the date a claim legally arose can be critical.

Wrongful death: Louisiana Civil Code Article 2315.2 generally states that the wrongful-death right prescribes one year from death or two years from the day injury or damage was sustained, whichever is longer.

Survival actions: Article 2315.1 uses similar language for the decedent's surviving cause of action—generally one year from death or two years from the day injury or damage was sustained, whichever is longer.

Latent asbestos diseases create difficult questions about when injury or damage was legally sustained. Maritime exposure, federal employment, military service, workers' compensation, governmental defendants, bankruptcy trusts, prior diagnoses, and exposure in multiple states may also change the analysis.

Do not calculate a deadline from diagnosis or death alone. Missing a prescriptive period can permanently bar a claim.
